This agreement contains the entire understanding between Client and Photographer. A signed “Engagement Session Contract” and payment of the $_______________ fee (due the day of the session) are necessary to confirm the stated services from  Photographer.

Cooperation: Clients and Photographer consent to happily cooperating and communicating with each other to achieve the best possible result within the understanding of this contract.

Schedule: Photographer's shooting schedule, style of working and experience are designed to achieve a great set of photos for Client, accomplished with good humor and enjoyed by all concerned. Both Client and Photographer therefore agree that punctuality and cheerful cooperation are essential to producing outstanding photographic results. In cases where Client or associated parties does not run on time (for example, extreme lateness) Photographer cannot guarantee to take his normal set of photos although in such circumstances Photographer will do his absolute best to accommodate.

Personal Cameras/Video: Photographer will be the sole photographer during the session. No personal cameras are recording devices are allowed.

Cancellations: Cancellations must be made no less than 72 hours before the session. Any cancellations received within 72 hours of the session will be subject to a cancellation fee of 25% of the services fee.

Travel Rates: Client understands that mileage/travel rates will apply at a rate of .58/mi (per IRS recommendations for 2019),  for any sessions located outside of a 30-mile radius of Zip Code of 90503. Quotes for travel fees are available upon request.

Final Photo Product: It is understood that Client is hiring Photographer for his technical and artistic expertise and, therefore, Photographer reserves the right to edit the Images as he sees fit. Client will not hold Photographer responsible for issues pertaining to his/her personal appearance (ex: hair, makeup, wardrobe malfunctions, etc) and understands that any requested editing regarding personal appearance may incur additional costs. 12-15 images for an one-hour session, and 25-30 images for a two-hour session will be delivered.

Copyright Law: All digital files will be delivered in high resolution format via online download. Clients will have the limited right to make and use copies of the digital images provided for personal use. The copyright of photographs remains with Photographer. Photographer grants Client permission to make copies of the images under the following conditions. The images taken by Photographer are for personal use and non-commercial use and distribution by Clients and his/her friends and relatives. All files included in digital collections are protected under Federal Copyright Laws and are the sole property of Photographer. Client understands that the included images are for personal printing only and may not be cropped, altered or color corrected in any way. Images may not be entered into contests or publications without Photographer's permission. Images may be posted to social media (with proper photo credit) but must remain intact (no cropping, filters, or alterations allowed). Sale, Publication or any Commercial use of the photographs is not allowed without prior written permission from Photographer. All copyright laws still apply.

Model Release: Client grant Photographer and his legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the photographs of Client for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images. Client hereby release Photographer and his legal representatives, heirs and assigns from all liability and claims in connection with the images.

Limit of Liability: If Photographer is too ill or becomes injured and cannot supply the services specified above Photographer will try to book a replacement photographer, or reschedule when able. If a replacement photographer, or a rescheduled date are not an option then liability is limited to a refund of any payments received. Photographer has working methods in place to prevent loss or damage to Client's images. However, there is the unlikely possibility that images may be lost, stolen or destroyed for reasons in or beyond Photographer's control. In these circumstances liability is limited to the return of fees paid for the service or part thereof according to the percentage of images supplied.

Late Policy: Arriving late to your session will result in loss of session time. Photographer reserves the right to cancel or reschedule the session due to Client’s late arrival.
